Clear Path YYC — Terms of Service

Effective Date: 13-August-2026

Welcome to Clear Path YYC.
These Terms of Service (“Terms”) govern all junk removal and related services (“Services”) provided by Clear Path YYC (“the Company,” “we,” “us,” “our”)
to any individual or entity that requests, books, or accepts our Services (“Customer,” “you”).

By requesting a quote, booking a job, or accepting our Services through our website, phone, text, email, social media, or in person, you agree to be bound by these Terms.
If you do not agree, please do not book or accept our Services.

1. Agreement to Terms

By booking or accepting Clear Path YYC’s Services, the Customer authorizes the Company to remove, haul, transport, donate, recycle, or dispose of the items identified by the Customer.
The Customer confirms they are the legal owner of the property involved, or have authorization from the property owner, to request these Services.

2. Ownership of Items

The Customer certifies that:

  • All items designated for removal belong to them, or they have legal authority to dispose of them.
  • No removed items are stolen, leased, or subject to any ownership dispute.
  • Once the Company removes items from the property, ownership of those items immediately transfers to Clear Path YYC.
  • Removed items may be donated, recycled, sold, or disposed of at the Company’s discretion, and cannot be reclaimed after removal.

3. Customer Responsibilities

The Customer agrees to:

  • Clearly identify all items to be removed prior to or at the time of service.
  • Ensure safe access to the property for our crew and equipment.
  • Keep children and pets away from the work area during service.
  • Disclose any known hazards prior to service, including but not limited to: mold, asbestos, biohazards, chemicals, sharp objects, structural concerns, electrical hazards, or pest infestations.

Failure to disclose known hazards may result in cancellation of service, additional fees, or refusal to complete the job.

4. Excluded Materials

Clear Path YYC reserves the right to refuse removal of:

  • Hazardous waste
  • Chemicals, paints, and solvents
  • Propane tanks
  • Ammunition and explosives
  • Biomedical waste
  • Radioactive materials
  • Asbestos-containing materials
  • Any item prohibited under Alberta law

5. Property Damage

While Clear Path YYC exercises reasonable care during removal, moving large or heavy items carries inherent risk.
The Customer acknowledges that minor cosmetic incidental damage may occur, including but not limited to wall scuffs, door frame marks, floor scratches, lawn ruts, or driveway marks.

The Company is not responsible for damage resulting from:

  • Existing structural weaknesses or hidden defects
  • Unsafe access routes
  • Overloaded or deteriorated stairs, or rotten flooring
  • Improper construction
  • Underground irrigation, utilities, or other hazards not identified by the Customer in advance

The Company remains responsible for damage caused by its own negligence, to the extent required by Alberta law.

Damage to Items Being Removed: The Customer acknowledges that items designated for removal may be damaged, broken, or destroyed during the removal, loading, or disposal process,
and Clear Path YYC is not liable for any such damage. Items are removed on an as-is basis, and the Customer assumes all risk of damage to items once they are designated for removal.

6. Limitation of Liability

To the maximum extent permitted by Alberta law, the Company’s total liability for any claim arising from the Services shall not exceed the total amount paid by the Customer for that service. Under no circumstances shall the Company be liable for lost profits, emotional distress, or any consequential, indirect, or special damages.

7. Release of Liability

By accepting our Services, the Customer voluntarily releases and discharges Clear Path YYC, its owners, employees, contractors, and agents from claims arising out of the junk removal services,
except where caused by gross negligence, willful misconduct, or where liability cannot legally be excluded under Alberta law.

8. Cancellations

Cancellations made more than 24 hours before the scheduled appointment are accepted at no charge.

Cancellations made within 24 hours of the scheduled appointment, including no-shows, will be subject to a $95 cancellation fee.

If the Customer cancels after the crew has arrived on-site, a service call fee may apply, as communicated at time of booking. If additional labour or disposal fees become necessary due to undisclosed items or site conditions, the Customer will be informed before work continues, and may decline the additional work.

9. Payment

Payment is due immediately upon completion of Services unless otherwise agreed to in writing. We accept cash, debit, credit card, and e-transfer. Late payments may be subject to applicable collection costs and interest where permitted by law. Final pricing is confirmed on-site and may vary from an initial estimate based on actual volume, weight, or conditions encountered.

10. Photographs

Clear Path YYC may take before-and-after photographs of completed work for documentation and quality purposes.
Customers will be asked separately for consent if any photographs are to be used for marketing or promotional purposes, and no identifying personal information will be included without consent.

11. Weather and Safety

The Company may postpone or cancel Services due to unsafe weather, hazardous site conditions, or other circumstances beyond its reasonable control.
We will make reasonable efforts to notify the Customer and reschedule promptly.

12. Changes to These Terms

Clear Path YYC may update these Terms from time to time. The version posted on our website at the time of booking will govern that service.

13. Governing Law

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein.

14. Entire Agreement

These Terms represent the entire agreement between the Customer and Clear Path YYC regarding the Services and supersede any prior verbal or written agreements,
except where a separate written contract has been signed for a specific job.
